The notices and their periods
- 5-Day Notice to Pay or Quit — for nonpayment (41 O.S. § 131(B)) — five days to pay in full or move out. A demand for past-due rent also counts as a demand for possession, so no separate notice to quit is needed. (A tenancy of three months or longer may get a 10-day notice.)
- 15-Day Notice to Cure or Quit — for a curable lease violation (41 O.S. § 132(B)) — the tenant has 10 days to fix the problem, and the tenancy ends at 15 days if it isn't corrected.
- 24-Hour / Immediate Notice — for conduct causing imminent and irremediable harm to the premises or others (§ 132).
Ending a tenancy and serving notice
To end a month-to-month tenancy without cause, give 30 days' written notice (41 O.S. § 111).
After the notice period, the landlord files a Petition for Forcible Entry and Detainer in district or county court.
The 10-in-15 cure window
